Welcome to the WTFMA Free Online Public Community (the “Community”). By accessing or using the Community, you agree to be bound by this Service Agreement (the “Agreement”). If you do not agree to all terms of this Agreement, you must not use or access our Community.

1. Acceptance of Terms

1.1 Binding Agreement. This Agreement is a legally binding contract between WTFMA (“we,” “us,” “our”) and the users of our free online public Community (“you,” “your,” “User”). By creating an account or otherwise accessing or using our Community, you accept and agree to be bound by the terms and conditions set forth here.

1.2 Modifications. We reserve the right to modify this Agreement at any time. Any changes will be posted in the Community, and we will update the “Effective Date” above. By continuing to use the Community after these changes are posted, you agree to the updated terms.

2. Eligibility

2.1 Minimum Age. You must be at least 13 years old (or the age of majority in your jurisdiction if higher) to access and use the Community. If you are under the age of 13 (or such other age of majority), you may not use or access the Community.

2.2 Compliance with Local Laws. You are responsible for ensuring that your use of the Community complies with any laws, rules, and regulations applicable to you.

3. User Accounts

3.1 Account Creation. To participate in certain features of the Community, you may be required to create an account by providing information such as your name, email address, and a unique password.

3.2 Account Security. You are solely responsible for maintaining the confidentiality of your account credentials and for any activities that occur under your account. You agree to immediately notify WTFMA of any unauthorized use of your account or any other breach of security.

3.3 Account Termination. We reserve the right to suspend or terminate your account for any violation of this Agreement or if we suspect any unauthorized use or misuse of your account.

4. User Conduct

4.1 Community Guidelines. The Community is intended to be a welcoming and constructive space. You agree to follow these guidelines:

  • Respect Others: Avoid personal attacks, harassment, hate speech, or discriminatory behavior.
  • No Illegal Activities: Do not engage in or promote any activities that are unlawful or violate third-party rights.
  • No Spam or Malicious Content: Refrain from spamming, posting unsolicited or deceptive content, or distributing malware or viruses.

4.2 User Content. You are solely responsible for all data, text, software, graphics, messages, and other content (“User Content”) that you upload, post, or otherwise transmit in the Community. You represent and warrant that:

  • You own or have the necessary licenses to post such User Content.
  • Your User Content does not violate any intellectual property or other third-party rights.
  • Your User Content does not violate this Agreement or any applicable laws.

4.3 Removal of User Content. We reserve the right, but have no obligation, to monitor or remove any User Content that we determine in our sole discretion violates this Agreement or is otherwise offensive or inappropriate.

5. Intellectual Property

5.1 WTFMA Content. The Community, including all content made available by WTFMA (such as text, graphics, logos, and software), is the exclusive property of WTFMA or its licensors and is protected by intellectual property laws. You agree not to reproduce, distribute, modify, or create derivative works without our express written permission.

5.2 User Content License. By posting User Content, you grant WTFMA a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works, display, and perform your User Content in connection with operating and promoting the Community.

6. Privacy

6.1 Privacy Policy. Your use of the Community is also governed by our Privacy Policy, which explains how we collect, use, store, and disclose your personal information. By using the Community, you consent to our collection and use of your personal information as outlined in our Privacy Policy.

6.2 Cookies and Tracking. The Community may use cookies or other tracking technologies. By using the Community, you agree to the use of such technologies in accordance with our Privacy Policy.

7. Disclaimer of Warranties

7.1 As-Is. The Community is provided on an “AS IS” and “AS AVAILABLE” basis. WTFMA makes no warranties, express or implied, regarding the operation or availability of the Community.

7.2 No Guarantee of Accuracy. While we endeavor to keep the information on the Community accurate and up-to-date, we do not warrant that any content is error-free, reliable, or complete.

7.3 Community Interactions. We do not screen or endorse any views or opinions expressed by Community members. Your decision to engage with other users or third parties is made at your own risk.

8. Limitation of Liability

8.1 Indirect Damages. In no event will WTFMA, its affiliates, or its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to this Agreement or your use of the Community.

8.2 Cap on Liability. To the fullest extent permitted by law, WTFMA’s total liability to you for any damages arising from or related to your use of the Community shall not exceed the greater of:

  • the total fees paid by you (if any) for your use of the Community during the twelve (12) months preceding the event giving rise to the claim, or
  • one hundred dollars ($100 USD).

9. Indemnification

You agree to indemnify, defend, and hold harmless WTFMA, its affiliates, and their respective officers, employees, contractors, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use or misuse of the Community.
  • Your violation of this Agreement or any applicable law.
  • Your infringement of any intellectual property or other rights of any person or entity.

10. Termination

10.1 Termination by User. You may terminate this Agreement at any time by discontinuing your use of the Community and deleting your account.

10.2 Termination by WTFMA. We may suspend or terminate your access to the Community at any time, with or without cause, and with or without notice.

10.3 Survival. All provisions of this Agreement that by their nature should survive termination (including, without limitation, ownership provisions, warranty disclaimers, indemnification, and limitations of liability) shall survive termination.

11. Dispute Resolution

11.1 Governing Law. This Agreement and any dispute arising from it shall be governed by the laws of [Your Jurisdiction], without regard to conflict-of-law principles.

11.2 Arbitration or Venue. Any disputes, claims, or controversies arising out of or relating to this Agreement shall be subject to [arbitration/venue specifics] in [Jurisdiction/Location]. You consent to personal jurisdiction and venue in [the designated forum or arbitration panel].

12. General Provisions

12.1 Entire Agreement. This Agreement, together with any policies referenced herein (such as our Privacy Policy), constitutes the entire understanding between you and WTFMA concerning the Community.

12.2 Severability. If any provision of this Agreement is found to be invalid or unenforceable, such provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

12.3 No Waiver. Our failure to enforce any term of this Agreement shall not be deemed a waiver of that term or any other term.

12.4 Assignment. You may not assign or transfer any of your rights or obligations under this Agreement without our prior written consent. We may freely assign or transfer our rights and obligations under this Agreement.

12.5 Headings. Headings used in this Agreement are for convenience only and shall not affect the interpretation of any provision.
